Wi-Fi Terms of Use
1. Subject and Scope of these Terms of Use
These terms of use regulate your and our rights and obligations in connection with the use of our guest Wi-Fi access.
2. Our Services
(1) We provide you with access to the internet in the form of a Wi-Fi connection (“Hotspot”) in our business premises for free use.
(2) The provision of the hotspot depends on our technical and operational capabilities. There is no claim to a functional hotspot or a specific local coverage of the hotspot.
(4) We reserve the right to change, restrict, or discontinue access to the hotspot without prior notice in case of necessary technical repair and maintenance work.
(5) There is no claim to the availability of specific services over the hotspot. For instance, port restrictions may be applied. Generally, surfing the internet and sending and receiving emails is enabled.
(1) We offer our guest Wi-Fi only to visitors of our company. It is not a publicly accessible telecommunications service but an internal Wi-Fi for guests of our company.
3. Access and Usage
(2) The prerequisite for usage is that you register for the hotspot and/or accept these terms of use when accessing the hotspot. This is typically done by selecting the hotspot as the Wi-Fi network on your device and accessing a registration form or a welcome page.
(2) The prerequisite for usage is that you register for the hotspot and/or accept these terms of use when accessing the hotspot. This is typically done by selecting the hotspot as the Wi-Fi network on your device and accessing a registration form or a welcome page.
(3) There is no claim to use the hotspot. We reserve the right to restrict or terminate access to the hotspot at any time without providing reasons.
(4) The latest version of these terms of use, which will be made available when registering for the hotspot, applies.
4. Access Data
(1) If you provide login data (such as username, password, email, etc.) during registration, you must keep it confidential and ensure it is not accessible to unauthorized third parties.
(2) If you have received registration data, you must ensure that access to and use of the hotspot with your login data is carried out exclusively by you as the user. If there are facts suggesting that unauthorized third parties have gained or will gain knowledge of your access data, you must notify us immediately.
(3) As a user, you are liable for any use and/or other activities conducted under your access data according to statutory provisions.
5. Your Obligations as a User
(1) You are required to provide truthful information about yourself when using the service.
(2) You are obligated to comply with applicable laws while using our hotspot.
(3) Other obligations arising from these terms of use remain unaffected.
6. Costs
The service is provided free of charge.
7. Service Availability
As our services are provided free of charge, you have no claim to use the hotspot. However, we strive to ensure the hotspot can be used with minimal interruptions.
8. Prohibited Actions
As a user, you are prohibited from engaging in any activities that violate applicable laws, infringe on third-party rights, or contradict principles of youth protection while using the hotspot. Specifically, the following actions are prohibited:
• Uploading, distributing, offering, or promoting pornographic content, content that violates youth protection laws, data protection laws, and/or other legal provisions, or fraudulent content, services, and/or products;
• Publishing or making content accessible that insults or defames other participants or third parties;
• Using, providing, or distributing content, services, and/or products that are legally protected or subject to third-party rights (e.g., copyrights) without explicit authorization;
• Publicly making copyrighted works accessible or engaging in other copyright-infringing actions, especially when using so-called "internet file-sharing platforms" or file-sharing services.
Additionally, regardless of any legal violations, the following activities are prohibited when posting your own content on the service provider’s internet page or communicating with other users (e.g., through personal messages, participating in discussion forums, etc.):
• Transmitting an above-average amount of data, especially persistent large data transfers;
• Hosting a web server or other servers using the service provider’s hotspot;
• Changing the preset DNS servers in the network settings of the service provider’s hotspot;
• Sending junk or spam emails and chain letters;
• Spreading viruses, Trojans, and other harmful files;
• Disseminating offensive, indecent, sexually oriented, obscene, or defamatory content or communications, or those likely to promote racism, fanaticism, hate, physical violence, or unlawful activities (explicitly or implicitly);
• Soliciting other users or third parties to disclose passwords or personal data for commercial or unlawful purposes.
Any action likely to impair the smooth operation of our hotspot, particularly overloading our systems, is also prohibited.
9. Blocking Access
We may temporarily or permanently block your access to the hotspot if there are concrete indications that you have violated these terms of use and/or applicable laws, or if we have any other legitimate interest in the blocking.
10. Indemnification
(1) As a user, you are solely responsible for all actions performed in connection with using the internet via our hotspot.
(2) You indemnify us against all claims that third parties assert against us due to a user’s violation of statutory provisions, third-party rights (particularly personality, copyright, and trademark rights), or contractual obligations, assurances, or guarantees, including the costs of necessary legal defense (attorney and court fees at statutory rates).
(3) In case of claims as outlined in section 10 (2), you are obliged to assist promptly and fully in clarifying the facts and provide us with the necessary information.
11. Limitation of Liability
(1) We are liable for all damages caused by us without limitation in cases of intent or gross negligence.
(2) In cases of slight negligence, we are liable without limitation in the event of injury to life, body, or health.
(3) Otherwise, we are only liable if we violate a material contractual obligation. Material contractual obligations are abstractly defined as obligations whose fulfillment is essential for the proper execution of the contract and upon which the user may regularly rely. In such cases, liability is limited to compensation for foreseeable, typically occurring damages.
(4) To the extent that our liability is excluded or limited according to the above provisions, this also applies to our agents.
(5) Liability under the Product Liability Act remains unaffected.
12. Data Protection
(1) We ensure that your personal data is only collected, stored, and processed to the extent necessary for providing the agreed-upon services and as permitted or required by law.
(2) If data protection consent declarations are obtained from you during the use of our services, it is noted that you can revoke them at any time with effect for the future.
(3) To provide the hotspot services, the use of personal data from your device is necessary. This may include temporarily storing MAC addresses of devices. Additionally, we may store log files about the type and extent of service usage for seven days. These data cannot be directly linked to you.
13. Final Provisions
(1) German law applies, excluding the application of the UN Convention on Contracts for the International Sale of Goods.
(2) If you are a merchant, a legal entity under public law, or a special fund under public law, our registered office is the exclusive place of jurisdiction for all disputes arising from the contractual relationship.
(3) Should individual provisions of these terms of use be or become invalid, the validity of the remaining provisions shall not be affected.
